By browsing, reading, downloading and using any function of this website, you are agreeing to comply with and be bound by the following Terms of Use, which together with our Privacy Policy and Disclaimer (the “Terms”) govern Changing Life and Wealth relationship with you in relation to this website. If you disagree with any part of these Terms, you should cease using Website immediately.

Definitions

In these Terms the following terms are defined as follows:

The term ‘Changing Life and Wealth’ or ‘us’ or ‘we’ refers to the owner of the website. The term ‘you’ or ‘Member’ refers to the user of the website and the service.

Account means an account or login details to use the Website Services set up by a User.

Content means the content uploaded onto the Website by Changing Life and Wealth and any course hard copy materials.

Intellectual Property Rights means industrial and intellectual property rights of whatever nature throughout the world conferred on Changing Life and Wealth under statute, common law or equity, whether existing now or at any time in the future in relation to the Website or otherwise;

(b) all rights belonging to Changing Life and Wealth in respect of or in connection with copyright, inventions (including patents), formulae, databases, business processes and methods, trademarks, service marks, business names, trade names, domain names, designs, confidential information, trade secrets or otherwise;

(d) the copyright subsisting in all documents and electronically stored files encompassing the things referred to in paragraphs (a) and (b); and

(e) any invention, discovery, or right to apply for a patent, trade mark or design in relation to anything referred to in paragraphs (a), and (b).

Member means a user who signs up for an Account on the Website.

Membership Fee and Programme Fee means the membership fees set out in clause 1.

Services means the services provided to the Member by the Changing Life and Wealth via the Website, retreats and all forms of electronic and data communications.

1. Membership and Pricing

In order to access the Services on the Website, retreat, coaching and via other data and electronic means you join and become a member. The service of Changing Life and Wealth that provides users with the opportunity to gain knowledge, skill, information and resources, are paid services.

Ongoing annual membership is only provided as part of either;

Ensemble programme
Select programme

Annual Membership Fee

A member pays just one ongoing fee that then reduces by over 95% after 6 months. This first 6 months of the ongoing fee is payable prior to the commencment of a programme. This fee is determined by which option is selected; Select or Ensemble. Members enrolled in either programme then pay $40 (AUD/SNG/NZD) per month starting from the cessation of the coaching component of the programme (usually at the six month point). This provides access to other members (if a member provides permission), and various tools, resources and investment related updates, and continued learning resources. A member can terminate membership from this point by providing written notice as described elsewhere in these terms and conditions.

Payment Terms:

1. Prepayment of the initial 6 month period of services

2. Ongoing services thereafter automatically commence and are debited from cessation of the coaching component

1. Programme Ongoing Fee

A person/ Trustee may elect to participate in either Ensemble Programme or the Select Programme. Both charge just one simple ongoing fee, with the first 6 months payable in advance in one payment. Thereafter this monthly ongoing fee is reduced by at least 95% payable quarterly or six monthly in advance.

Amount:

The Ensemble Ongoing Fee is as per advertised on the website and/or Membership Brochure.

Select Ongoing Fee is as per one to one confidential discussion and will be confirmed in writing.

A deposit of $300 is required at the time registering for either programme and must occur at least 6 weeks prior to the date of the first retreats' commencement. Then;

6 weeks prior to the first retreat commencement date the balance of the initial 6 months ongoing annual fee's first installment is due in full.

Important things you should keep in mind:

Changing Life and Wealth has sole discretion in accepting a payment after this date to attend the retreat/ participate in that intake of the programme.
Changing Life and Wealth will conduct the retreat on a set date on a ‘best endeavors’ basis acknowledging that factors beyond its control may require a postponement or relocation to an alternative location. This will be notified by email no later than 4 weeks from the retreat commencement date wherever possible.
A minimum of 5 participants (not including partners) is required for an Ensemble retreat to proceed. We will confirm the retreat date by email notification to you approximately 6 weeks prior to the commencement of the retreat.
We strongly recommend that when booking airfares you ensure they are changeable/refundable in the advent of a change of retreat date occurring. We bear no responsibility for, or liability of costs associated and incurred by you caused by a change of retreat date (e.g. airfares, booking fees, extra flight costs, additional accommodation costs et al associated with a new date).
Examples would include such things as airline flight cancellations, civil unrest/ strikes, extreme weather conditions, or natural disasters or where the governments of either Australia or new Zealand had a "do not travel' advisory warning in place. It is recommended attendees arrange sufficient insurance to cover such events along with sufficient medical travel insurance.
In these circumstances a full refund of the initial 6 months is offered if we are not able to arrange an alternative location and date to take place within 2 months of the original intended retreat date

2. Ongoing Fee (after the first 6 months)

This payment will automatically occur (via direct debit or similar bank provided automatic payment service against a credit card or bank account provided by the member) at the conclusion of either 6 or 9 month initial coaching period from the date of the first retreat the member participated in. Should a programme attendee or an ongoing current member subscriber wish to cease/not participate in the ongoing access to services (membership) then they must;

Notify by email Changing Life and Wealth with 2 months’ notice. Simply state that you wish to not proceed/ cease Membership and two months from that date, services will cease.
Any refunds for unused monthly services will be refunded within 1 month from receiving the cancellation.
Changing Life and Wealth may elect to provide the ongoing member service at no-charge during the 6 or 9 months proceeding the first retreat at its absolute discretion.

No personal/specific advice as to what a member should do or not do; buy, sell or hold is ever provided by Changing Life and Wealth.com. Specific product or investment discussions will not form part of this service.

2. Refunds, postponements and relocations

Where the attendee has booked and paid for their own airfares (and any other related expenses or bookings not a part of the Programme), then Changing Life and Wealth is not liable for any additional fees, losses, costs or liabilities incurred by the attendee when such a postponement or cancellation of the programme/retreat occurs.
Where Changing Life and Wealth arranges flights and any other additional expenses and services then Changing Life and Wealth is liable for those specific expenses and services as part of the programme. We are not liable for any other losses or costs or liabilities incurred by the attendee before, during or after the retreat outside of what we listed to you in our 'Confirmation of Attendance' notification.
We will endeavour to provide any postphoned services at the next available programme start date within 2 months of the intended date. Failure by the attendee to utilise these services by not attending the programme and new retreat date (a set by us) results in forfeiture of the services/ benefits and their ongoing programme fee paid to that point. An attendee cannot set the amended start date/ retreat date. Changing Life and Wealth will use a ‘best endeavours’ approach to organising a date to best suit the attendee (and also other participants where a group programme is elected).
No cash refund is provided in any circumstance unless;

The attendee (or their live in spouse/partner) dies or suffers a terminal illness with sufficient independent professional medical practitioner proof of such being provided prior to the retreat commencement date.
Changing Life and Wealth does not provide an alternate date to attend a retreat/commence a programme within 2 months of the intended retreat date (same or similar location as determined by us)
Grant Pearson as host and programme leader is unable to conduct the retreat/ programme due to ill health or death.

More you should know!

The attendee must hold a valid passport and visa for entry into Australia or New Zealand or Indonesia (for a time period of at least 2 weeks duration). The attendee is solely responsible for ensuring they are in possession of such at the time of travel and the associated costs in securing visas etc. No refund is provide for a no-show due to being unable to enter the nation of where the retreat is conducted due to failure to organise the required passport and visa requirements (or is barred entry to the nation where the retreat is being conducted).
In the case of an airline cancelling or postponing a flight,;
- Ensemble: the retreat will still proceed at the place and time of the retreat date notified by us to you. No refunds or postponements will be entertained (except where noted previously) and so we recommend you arrive at least 1 day prior to the commencement date (accommodation for that night would be at your expense). You are fully liable for any additional costs you may have to incur to still attend the retreat. If you choose not to attend, it is at our sole discretion as to whether we credit your fee paid for another retreat intake or forfeit part/all of the fee paid.
- Select: Where practical for us, we may in some circumstances delay the retreat commencement date but only by 48 hours, again on a best endeavours basis with any third party additional costs incurred payable by you upon presentation of an invoice(s) of the third party(s).
Changing Life and Wealth reserves the right to change the location and country of the retreat at its sole discretion for any reason whatsoever. Written notice via email will be given to attendees as soon as practicable and before 4 weeks of the retreat commencement date where we are able. Changing Life and Wealth will reset the retreat date and/or to another location or time within 2 months of the intended retreat date. This may be required to be exercised if for example, a nation experiences civil unrest or catastrophe and is classified by the host country via its foreign affairs department as ‘High Risk’ or “Do Not Travel’ for travel by foreigners on their published website.

In these circumstances we are not liable for any re-booking fees, costs, fees or liabilities for re-booking to an alternate country, date or airline incurred by you. A decision by the attendee not to travel for any reason outside this clause or in clauses noted previously results in forfeiture of their initial ongoing fee payment made to date. At its absolute discretion Changing Life and Wealth may chose however to do so in part or in full.

3. Website Content

All content shown on the site is provided in good faith and derived from information believed to be accurate at the time of publication. We do not provide any warranty or guarantee as to the accuracy, timeliness, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

4. User Representations and Warranties

(a) You agree to provide Changing Life and Wealth with true, accurate, current and complete information.

(b) You agree not to misrepresent your identity or any information.

(d) You agree to not use the Website or the Service for any purpose that is unlawful or prohibited by these Terms.

(e) You agree that all User content posted by you is owned by you and our use of such User Content does not infringe or violate the Intellectual Property Rights or any other rights of anyone else. You licence us to use, modify, adapt, publish, display, sublicense, create derivative works from and incorporate in other works any User content by you, at any time in the future in any form and for any purpose and warrant that you have the right to grant this licence.

5. Disclaimer

(a) Your use of any information or materials on this Website is entirely at your own risk, for which we shall not be liable. Services and Content are provided to you "as is", and Changing Life and Wealth expressly disclaims all warranties of any kind, either implied or express, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. It shall be your own responsibility to ensure that any information available through this website meets your specific requirements.

(b) Changing Life and Wealth makes no warranty, either implied or express, that any part of the Service will be uninterrupted, error-free, virus-free, timely, secure, accurate, reliable, or of any quality, nor is it warranted either implicitly or expressly that any content is safe in any manner for download.

(c) The information provided and any output from tools and resources available via Changing Life and Wealth is intended to represent an illustration of possible results or outcomes you could achieve in the future. None are guaranteed. Given your circumstances are unique and can change at any time in the future, Changing Life and Wealth cannot and does not guarantee the accuracy, completeness, timeliness or reliability of future projections provided on or through the Web Site.

(d) Any output of any kind from third parties, calculators , tools and the like sourced from or via Changing Life and Wealth is not guaranteed as being accurate or reliable by Changing Life and Wealth. Our selection and utilisation of such is made entirely on our view as being suitable and accurate. No warranty by Changing Life and Wealth is provided or inferred.

6. Limitation of Liability

(a) To the maximum extent permitted by law you expressly understand and agree that Changing Life and Wealth will not be liable for any direct, indirect, special, incidental, consequential or exemplary damages suffered by you, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible assets (even where Changing Life and Wealth has been advised of the possibility of such damages), resulting from:

a. the use of Services or the inability to use Services;

b. the cost of obtaining substitute goods and/or services resulting from any transaction entered into or recommendation made on/through Services;

c. statements by any third party or conduct of any third party using Services; or

d. any other matter relating to Services.

(b) Changing Life and Wealth liability for breach of any implied warranty or condition which cannot be excluded is limited at our option to the fees paid by you in the 12 months preceding notification of any breach by Changing Life and Wealth by you.

(c) Subject to our obligations under any implied conditions and warranties referred to in paragraph (a), our maximum aggregate liability for all claims under or relating to these terms and conditions or their subject matter, whether in contract, tort (including without limitation negligence), in equity, under statute, under an indemnity or on any other basis, is limited to AUD $100. In calculating our aggregate liability under this clause, the parties must include any amounts paid or the value of any goods or services replaced, repaired or supplied by us for a breach of the implied conditions and warranties referred to in paragraph (a).

7. Indemnity

You agree to indemnify and hold Changing Life and Wealth, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable legal expenses, made by any third party due to or arising out of your use of the Service in violation of this these Terms.

8. Third-Party Advertisers

Changing Life and Wealth may run advertisements and promotions from third parties on the Site. Your business dealings or correspondence with, or participation in promotions of, advertisers other than Changing Life and Wealth, and any terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party.

Changing Life and Wealth is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of third-party advertisers on the Site.

9. Intellectual Property

(a) You acknowledge that the Website, the Service and all related content are subject to copyright and possibly other intellectual property rights (Intellectual Property Rights).

(b) We grant you a limited, non-transferable licence to access and use the Website and the Service solely for your personal use and only for these purposes.

(c) We (or our licensors) retain all right, title, and interest in and to the Website, the Service and all related content, and nothing you do on or in relation to the Website, the Service or any of the related content will transfer any Intellectual Property Rights to you or, except for the licence referred to in paragraph xxxx, licence you to exercise any Intellectual Property Rights unless this is expressly stated.

(d) Except as provided in these terms and conditions, permission to reprint or electronically reproduce the Website, the Service or any related content in whole or in part for any other purpose is expressly prohibited, unless prior written consent is obtained from us.

(e) Subject to applicable law, we may revoke the permission referred to in paragraphs at any time and may suspend or deny, in our sole discretion, your access to all or any portion of the Website or the Service without notice.

11. Non-commercial Use by Members

The Website and service is for the personal use of individual Members and may not be used in connection with any commercial endeavours, unless prior approval is obtained in writing from an authorised representative of Changing Life and Wealth. Organisations, companies, and/or businesses may not become Members and should not use the Service or the Web Site for any purpose. Illegal and/or unauthorised uses of the Web Site, including collecting usernames and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email and unauthorised framing of the Web Site is prohibited.

12. Termination of Membership

Use of the Website and programme materials and content is with the permission of Changing Life and Wealth and payment of the Membership Fees which may be revoked at any time, for any reason, in Changing Life and Wealth sole discretion.

13. Dispute Resolution

If you have any problems with the Website or your Membership please email us at Changing Life and Wealth stating your grievance and or request for consideration. We endeavour to respond within 2 Business Days.

14. General

(a) If any part of these terms and conditions is held to be unenforceable, the unenforceable part is to be given effect to the greatest extent possible and the remainder will remain in full force and effect.

(b) These terms and conditions are governed by the laws of New Zealand, and you irrevocably submit to the exclusive jurisdiction of the courts of New Zealand.

(c) These terms and conditions constitute the entire agreement between us and you in relation to the Website and your use of the Services and supersede all other (prior or contemporaneous) communications or displays whether electronic, oral, or written, between us and you in relation to the Website and the Services.

(d) Your use of the Service is conducted electronically and you agree that we may communicate with you electronically for all aspects of your use of the Service, including sending you electronic notices.

(e) The provisions of these terms and conditions which by their nature survive termination or expiry of these terms and conditions will survive cancellation of your registration or termination or expiry of these terms and conditions.

14. Notices:

All formal correspondence is via email by us to an email address nominated by you upon registration (or later by you via email notice to our email address). Any notice or correspondence we send to you to this email address will be deemed to be the means and date and time the notice/ correspondence was also received by you. We may also ask for a physical address to send any programme materials and the retreat pack. Time is GMT + 12hrs.

This Privacy Policy sets out how Changing Life and Wealth, uses and protects any information that you give Changing Life and Wealth when you use this website.
